The Food Safety and Standards Act is a consolidating act that relates to food safety and regulation in India.

According to the FSSAI rules, no person carry out a food business without obtaining an FSSAI license or FSSAI registration. So, it is a must for a processing, packaging, or food distributing entity to obtain FSSAI license. The registration is valid only for one-two years. Then the applicant can renew the license before the end of its validity.

Eligibility criteria for registrations under the FSSAI

Primarily, there are three categories in accordance with the kind of annual turnover of your business.

  • Basic Registration: For food business with an annual turnover of Rs. 12 lakhs.
  • State License: For businesses with an annual turnover of Rs. 12 lakhs to 20 crores.
  • Central Licence: For food businesses with an annual turnover above Rs. 20 crores.
Who should obtain FSSAI license?

FSSAI registration is required for Food Business Operators who:

  • A person who manufacture or sell any food article himself.
  • Distributes foods in religious and social gatherings, except a caterer
  • Other business activities related to food whose annual turnover does not exceed INR 12 lakhs
  • Their food production capacity should not exceed 100kg per day (other than meat and meat products and milk and milk products)
  • Their collection of milk it up to 500-liter milk per day and their slaying capacity is 50 poultry birds or 10 small animals or 2 large animals per day.
Procedure for obtaining FSSAI Registration:

The procedure to obtain FSSAI license is:

  • Initial step is submitting FORM A or B to the food and safety department.
  • The application can be rejected or accepted by the food safety department within 7 days. This will be intimated to the applicant through writing.
  • In case the FSSAI application is accepted, the Food Safety Department will grant a registration certificate along with the registration number and the photo of the applicant.
  • The food business operator must display the registration certificate in his office premises or print the FSSAI registration license number on the food product.
Documents required for the FSSAI registration are:
  • Form A – Duly filed and signed by the applicant
  • Photo identity of the food business operator
  • Tenure of premises proof, such as a rental agreement
  • Partnership Deep/ Articles of Association or Certificate of Incorporation, etc.
  • List of the food items to be dealing
  • Food safety management plan

  • Entire Plan of the food processing unit
  • List of all the machinery and equipment installed and used with the number and installed capacity
  • Authority letter from manufacturer
  • NOC and a copy of the license from manufacturers
Additional Documents for Central License
  • Analysis report of water from government health laboratory in order to confirm that the water is potable.
  • Import export code officially issued by the Directorate General of Foreign Trade
  • Pesticide Residue Report for water units engaged in manufacturing mineral or carbonated water
  • Sources of all the raw materials used such as milk or meat etc.
  • Proof of annual turnover, if required
  • Vehicles turnover proof, if applicable
