  • The designs should be applied to any article by any industrial process. Normally, designs of artistic works like painting, sculptures and industrial process are excluded from registration under the Act.
  • Any mode or principle of construction or operation or anything which is in substance a mere mechanical device, would not be registrable design.
  • The design does not include any Trademark or Copyright.

    Yes, the designs registered are open for public inspection only after publication in the official journal on payment of prescribed fee on a request with Form-5.
